Plan Room Terms and Conditions
The Plan Room is an annual subscription service provided by Schwab Eaton, P.A. (hereinafter referred to as “SE”) to professional contractors, licensed by the appropriate authorities to perform work in the city, county, or state where Work is to be performed, (hereinafter referred to as the “User”). The purpose of the Plan Room is to distribute bid documents (plans and specifications), project updates, and other information pertaining to SE projects via electronic formats to Bidders interested in bidding on proposed Work.

Acceptance of Terms
The User shall be responsible to adhere to the terms, conditions, and Privacy Policy described herein. SE reserves the right to update the Terms and Conditions at any time without prior notice.
Registration Acceptance
To access the Plan Room the User must provide current, accurate, and truthful registration information. Failure to provide said registration information will result in denial or termination of service. The User is responsible for updating account information as soon as it changes. SE shall not be responsible for registration information that is incorrect, outdated, or otherwise inaccurate.
Subscription and Renewal Information
The User agrees to pay SE $25.00 per year to access and use the Plan Room services. Subscriptions shall be valid for one year from the calendar day that an application and payment method is submitted to schwab-eaton.com. SE will send an automated Subscription Renewal Reminder to the User’s E-Mail on file with the Plan Room prior to the anniversary date of the subscription. The Renewal Reminder will contain instructions to renew the User’s subscription to the Plan Room for a consecutive year. Failure to renew service by the anniversary date will cause the User’s subscription to the Plan Room to expire, and all access to the Plan Room and associated services will be denied. Service may be reinstated at any time by contacting SE directly at 785-539-4687. SE will retain the User’s information in our database for up to six (6) months from the Plan’s expiration date to expedite renewal of services.
Termination
The User may cancel their subscription to the Plan Room, Project Notifications, Project Updates or other services governed by these terms and conditions at any time. The User agrees that SE may delete your User ID for any violation of this policy or our Privacy Policy. Annual subscription fees are non-refundable.
Delivery of Electronic Files
The User and SE agree that electronic files furnished at the Plan Room shall be provided in read-only PDF format. PDF files may be encrypted and/or password protected to prevent unauthorized changes. Adobe Reader or other PDF viewer is necessary to access and view PDF files. Adobe Reader is offered as a free download from http://get.adobe.com/reader/. SE assumes no liability for the User’s failure or inability to properly download, install, or use any software required for the use of these electronic files.
Project Notifications
SE provides the Plan Room and associated notification services as a convenience to the User, and does not guarantee that all persons on project notifications lists will receive notifications. Therefore, the User agrees to monitor the Schwab Eaton Plan Room site for all information relevant to desired projects. If the User believes they are not receiving notifications for which they are registered, contact SE directly at 785-539-4687.
Ownership of Instruments of Professional Service
In downloading and utilizing any drawings, reports, and data furnished by SE through the Plan Room, the User agrees that all such electronic files are instruments of professional service of SE and shall remain the property of SE. SE shall retain all common law, statutory, and other reserved rights, including the copyright thereto. Under no circumstances shall delivery of the electronic files for use by the User be deemed a sale by SE.
The User agrees not to reuse these electronic files, in whole or in part, for any purpose other than for bidding the Project for which the electronic files are explicitly intended. The User agrees not to transfer these electronic files to others without the prior written consent of SE. The User further agrees to waive all claims against SE resulting in any way from unauthorized changes to or reuse of the electronic files for any other project by anyone other than SE.
Unauthorized Changes
In the event the User or anyone for whom the User is legally liable makes or permits to be made any changes to reports, plans, specifications, or other construction documents prepared by SE without obtaining SE’s prior written consent, the User shall assume full responsibility for the results of such changes. Therefore the User agrees to waive any claim against SE and to release SE from any liability arising directly or indirectly from such changes.
In addition, the User agrees, to the fullest extent permitted by law, to indemnify and hold harmless SE from any damages, liabilities or costs, including reasonable attorneys’ fees and costs of defense, arising from such changes.
Security
The Plan Room is for authorized use only. The User shall be responsible for the confidentiality of their User ID and password. Notify SE immediately if you detect a security breach.
Viewing materials and downloading documents from the Plan Room is at your own risk. SE assumes no liability for any direct, indirect, incidental, punitive, or consequential damages derived as the result of visiting our web site. SE assumes no liability for any physical or psychological damages, or loss of services, income or welfare resulting from any virus that may infect computer equipment used to access our site.
SE is not responsible for any content of non-SE web sites, which may be linked from our web site. SE does not endorse any other site or content to which our site may have a hyperlink. All such viewing is at your own risk.
